Rights to Use Trademarks

Please make sure before submitting a design to Promo Products Direct, that you warrant and represent that you are the sole, legal owner, authorized agent or licensee of all rights, including copyright, to each copyright, trademark, service mark, trade name, logo, statement, portrait, graphic, artwork, photograph, picture or illustration of any person or any other intellectual property included in such design.

Use of any Logo for promotional purposes without the prior written consent of authorized agent or affiliate of the register owner of the logo may constitute trademark infringement and unfair competition in violation of federal and state laws.

A customer who submits copyright, trademark, service mark, trade name, logo, statement, portrait, graphic, artwork, photograph, picture or illustration of any person or any other intellectual property included in such design agrees to indemnify and hold harmless Promo Products Direct and its agents, employees or any other person against loss or expense including attorneys’ fees for illegal use. Promo Products Direct will also not accept responsibility or liability for the actions of clients who have misrepresented their ownership of licenses or trademarks.
